Adoption – Applying to inspect files

As an adopted person, you may access your adoption file to obtain information about your origins and life story. This applies only if the interests of other parties concerned – particularly your birth parents – do not conflict with this and do not take precedence.

You will be supported by a specialist from the adoption agency.

You may also access your records held by the registry office.

The records and documents relating to each adoption are kept for 100 years from the child’s date of birth.

Prerequisite

If you would like to view the placement files:

You must

  • have been adopted and are at least 16 years old, or
  • an adoptive parent and your adopted child, whose records you wish to view, is not yet 16 years old.

If you wish to view the data at the registry office:

The following persons may inspect the civil status register at the registry office:

  • the adoptive parents,
  • their parents,
  • the child’s legal representative, and
  • the child themselves, provided they are at least 16 years old.

This restriction ceases to apply upon the child’s death.

Following the child’s death, the following persons may inspect the civil status register:

  • persons to whom the register entry relates and
  • their spouses, civil partners, ascendants and descendants.

Other persons have a right of access if they can demonstrate a legitimate interest. In the case of the birth or death register, demonstrating a legitimate interest is sufficient if the application is made by a sibling of the child or the deceased. Persons aged 16 or over are entitled to make an application.

If paternity has been acknowledged despite existing paternity, information from, and access to, the results of a genetic paternity test included in the collective files may only be granted to the person acknowledging paternity, the mother, the child and the other man whose consent is required under Section 1595a of the Civil Code (BGB) is required.

Procedure

If you would like to obtain information about your origins, you must contact the adoption agency that arranged your adoption. The staff there will allow you to view the files and provide you with information about your origins and general circumstances, such as the reasons why your birth parents gave you up for adoption. As a rule, the file also contains reports on your development, which the adoption agency drew up as part of its aftercare support.

Please note: The right to access the files is restricted where this conflicts with the overriding personal interests of the individuals involved. In such cases, sensitive sections are usually redacted.

If you wish, the professionals will attempt to establish contact with your birth parents. If your birth family also wishes to get in touch with you, they will usually facilitate this.

The adoption agency endeavours to find an appropriate, individual solution for the birth parents and siblings from the family of origin as well. There is no right to access the files.

To view the civil register, it is advisable to make an appointment to visit the registry office in person. You can also request this information in writing, by fax or – where the relevant local authority offers this service – online.
